Client v. Restaurant
In August of 2009, Wendt Goss, P.C. confidentially settled a Salmonella poisoning case against a local restaurant for $500,000.00. In the case, Client and his family went to Restaurant for brunch, where Client ordered Eggs Benedict for his meal. A day later, Client began having severe abdominal cramping and diarrhea. His nausea, diarrhea, and vomiting proceeded throughout the entire night, and he presented to a local hospital the following day.
The hospital’s emergency room personnel performed a thorough examination and determined that Client was suffering from Salmonella poisoning. As a result, Client suffered from acute renal failure due to dehydration, severe diarrhea, and other ailments. After some routine CT scans, Client became acutely short of breath and was transferred to the medical intensive care unit. He was placed on a CPAP machine and eventually intubated. Tragically, his medical condition spiraled downward for the next several days. In total, Client was seen by more than 15 doctors, therapists, and other healthcare providers during that time period. After missing the entire holiday season with his family, Client was finally discharged from the hospital. Throughout the entire ordeal, he suffered from sepsis secondary to Salmonella poisoning, adult respiratory distress syndrome secondary to sepsis, encephalopathy and profound debility secondary to sepsis, urinary tract infection, acute renal failure, and numerous other severe medical problems.
Wendt Goss, P.C. filed a lawsuit against Restaurant on Client’s behalf and aggressively pursued extensive discovery. After Wendt Goss, P.C. disclosed its four nationally prominent experts, Restaurant proposed engaging in settlement negotiations. Ultimately, Client decided to accept a settlement to achieve a sense of closure and not be forced to relive this terrible nightmare at trial. When taking into consideration all the facts of the case, a settlement of $500,000.00 was reached by the parties.
